WHATABURGER Drive-Thru at 1601 Laurens Rd
WHATBURGER got their permits in before the new zoning came into effect.
They are seeking a special exception permit to operate their drive thru after midnight.
After the July 31st meeting the BZA (Board of Zoning Appeals) will hear the matter, potentially August 10th.
WHATBURGER is required to notify surrounding area of the meeting, up to a 1000 ft. This process may move quickly if they get on the August date.
Public Meeting: WHATABURGER drive-thru special exception
When: July 31st
Where: Hughes Library (25 Heritage Green Place)
Time: 6pm to 7pm
2023 BZA Schedule
I assume they’re going for the August meeting, which is August 10. The public notice for that BZA meeting will be posted July 26th, which should include the agenda.
You will be able to find the agenda in the Agenda Center
Application for Special Exception (refer to Pg. 3 for “special exception”). This is the criteria against which staff and the BZA will evaluate the application.
You will find four criteria.
1. This one refers to GVL2040, which is the citywide comprehensive plan adopted in 2021. Also see link to webpage. Pgs. 64-67 may be a good place to start.
2. This is under the old Land Management Ordinance. For this application, you’ll want to specifically look at Sec. 19-4.3.3(C), which is use specific standards for eating establishments. See Sec. 19-4.3 and you’ll need to scroll down to get to the specific section.
Questions 3-4 don’t really have specific sources to reference, but the site plan should be included in the agenda package once that is posted. You could scan Chapter 19, Land Management Ordinance (link above) for reference to standards, and utilize Greenville County GIS as well.
